Polices got Notices from AP High Court in 2010 by Nmart
Earlier in 2010, 7th Town Police Station, Vijayawada, Krishna Dist, A.P. were filed a case against Nmart and the police people giving harassment to Local Nmart Leaders. Connection with Nmart has filed a Writ Petition No. 24210/2010 against
1.Station House officer, 7th Town Police Station, Vijayawada
2.The Circle Inspector Narasaraopet PS, Guntur Dist,
3.The Director General of Police, Government of Andhra Pradesh, A.P
and
4.Government of A.P. Represented by its Principal Secretary, Home Department, Secretariat.
According to Files/Affidavits filed by Nmart the Honorable Justice N.V. Ramana was given a NOTICES to all above respondents on 29th September 2010 with M.P. No. 30984/2010 and stated that it will not come under Money Circulation Scheme and added it is come under Government Letter DO No. 21/22/2001 dated 31/3/2003.

Indian Govt close to finalizing new rules for multi level marketing
New Delhi: The government today said it is close to finalizing new rules for multi-level marketing firms and is working on an early warning system to prevent corporate frauds. The Serious Fraud Investigation Office (SFIO) -- under the Corporate Affairs Ministry -- is working on an early warning system that would help in preventin
g corporate frauds.
Corporate Affairs Minister Veerappa Moily said the SFIO has already set up a computer lab for this.
"This is part of the ministry's vision for having enlightened regulations," Moily said, while addressing the Economic Editors' Conference here.
The analysis wing of SFIO has come out with many reports and the ministry is acting upon that information, he added.
Besides, the ministry said the new rules for multi-level marketing companies have almost been finalised.
"We had a close discussion with the Department of Financial Services in the Ministry of Finance. The Act, the Prize Chits and Money Circulation Schemes Act (Banning) 1978, under which these activities can be controlled are under their purview," Corporate Affairs Secretary Naved Masood said.
"Together, we have decided that we should have new rules to prevent these companies from getting on with their nefarious activities," he added.
The new rules have been finalised and the RBI has been consulted on the same, Masood added.
Further, he noted that the Registrars of Companies (RoCs) have been asked to be "very very alert about the activities of these (multi-level marketing) companies, particularly where they give advertisements etc..."
SFIO is already investigating alleged scam at SpeakAsia, which is registered in Singapore. The ministry had ordered the probe into it early last year.

Hope All Nmartians will get good news on 8th October, because TWO Writs has come to hearing in AP High Court and THREE Writs has come to hearing in MUMBAI High Court. In total 5 writs, if any one writ comes in favour of us... there started to end the problem...

Rajasthan Govt Guidlines on MLM Marketing/ Direct Selling
Direct Selling Guidelines by Rajasthan Govt:
RAJASTHAN GAZETTE EXTRAORDINARY

No. F5(2) Ind/1/2012: To regulate the sale of goods and services outside of retail establishments otherwise known as "Direct Selling (Multi Level Marketing)" and to provide for protection of consumers who purchase goods and services from direct sellers, following guidelines are issued with the approval of the Competent Authority, These guidelines will come into force from the date of publication in official Gazette and will remain in force till an appropriate legislation is enacted for the said purpose.
Conditions for Permissible Direct Selling:
1. Should be a Direct Selling Entity, having sales tax/Vat, Income Tax, TDS and other licenses may be required as per the law/regulation of its principle place of business
2. Should have bank account with at least one nationalized bank.
3. Partnership Deed or Memorandum of Association should clearly state their nature of business. (Those who not have such specific clauses should get their memorandum of Association or Partnership Deed, as the case may be amended within 2months from the date of publications of these Guidelines.
4. Pay Sales Incentive at the agreed rate within the agreed period.
5. Shall display names and Identification Numbers of their authorized Direct Sellers in the official websites.
6. Should have a consumer grievance cell that should ensure redressal of consumer grievances with in 7days from the date of making such complaints.
7. Website should provide space for registering consumer complaints hassle free.
Appointments/Authorizations
1. Direct Selling Entity shall appoint/authorize Direct Sellers upon receipt and scrutiny of application in a prescribed format.
2. An agreement recording terms of such appointment should be executed between the Direct Selling Entity and Direct Seller.
3. No application should be considered unless such applicant is eligible to enter into a contact under the Indian Contract Act.
4. Each Direct Seller shall be allotted Unique Identification Numbers before granting license/permission to start Direct Selling.
